This website is operated by COTA Foundation, a faith-based 501(c)(3) nonprofit organization based in Hilo, Hawaiʻi Island (EIN 39-2930549). By accessing or using this site, you agree to these Terms of Use. If you do not agree, please do not use the site. We may update these terms from time to time, and continued use of the site after an update means you accept the revised terms.
Acceptable use
You agree to use this website lawfully and respectfully. You may not:
- Submit false, misleading, or fraudulent information through any of our forms.
- Attempt to gain unauthorized access to the site, its systems, or its data.
- Interfere with the operation of the site, including through automated scraping, spam, or malicious code.
- Use the site or its content to harass, defraud, or harm any person or organization.
Content ownership
All content on this site — including text, program descriptions, stories, photographs, illustrations, graphics, logos, and the COTA Foundation name — is owned by COTA Foundation or used with permission, and is protected by United States copyright and trademark law. You may view, print, and share this content for personal or noncommercial informational use, provided you keep it unaltered and credit COTA Foundation. Any other reproduction, distribution, modification, or commercial use requires our prior written permission.
If you send us content — a message, a photo, a testimonial — you grant COTA Foundation permission to use it in connection with our charitable work, unless you tell us otherwise in writing. We will not publish the name or story of a program participant without written permission.

This website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We work to keep information accurate and current, but we do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or up to date.
Nothing on this site is legal, financial, medical, or professional advice, and submitting a form does not create any guarantee of assistance. Program availability depends on funding, volunteers, and capacity.
Limitation of liability
To the fullest extent permitted by law, COTA Foundation and its directors, volunteers, and representatives will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, this website or its content.
Third-party links and forms
This site links to third-party services, including Jotform for our help request and donate goods forms. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.
Donations
Donations to COTA Foundation are voluntary and, except as required by law, are non-refundable. Gifts are used to advance our charitable mission, and unless a gift is restricted by written agreement, COTA Foundation directs it where the need is greatest. Contributions are tax-deductible to the extent allowed by law; please consult your tax advisor.
Governing law
These Terms of Use are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-law principles. Any dispute arising from these terms or your use of this website will be brought exclusively in the state or federal courts located in the State of Hawaiʻi, and you consent to their jurisdiction.
